Moscow. 20th of December. INTERFAX.RU – The Colorado Supreme Court has ruled that former President Donald Trump’s candidacy in next year’s state primaries is constitutionally prohibited, US media reported.
“A majority of the Court holds that President Trump is disqualified from holding the office of President under the Third Section of the Fourteenth Amendment to the United States Constitution,” the court’s ruling said.
The 14th Amendment states that officials sworn to support the Constitution are prohibited from holding future office if they have “engaged in rebellion.”
The court delayed its decision until January 4 so Trump can seek review by the Supreme Court.
If he does, his name will automatically remain on the ballot until the judges hear the appeal.
Colorado election officials said the issue must be resolved by Jan. 5, the legal deadline for the GOP primary field.
Similar cases against the 45th American president have also been filed in other states, including Michigan and Minnesota, but none of them succeeded in removing the ex-president’s name from the ballot.
During the campaign, Trump ridiculed the lawsuits and argued that they were an attempt to use the courts to prevent him from returning to the White House.
Meanwhile, the Trump campaign said it would “quickly appeal” the Colorado Supreme Court’s decision.
“The Colorado Supreme Court issued a completely erroneous decision this evening, and we will quickly appeal to the United States Supreme Court and concurrently request a stay of this deeply undemocratic decision. We have every confidence that the United States Supreme Court will quickly rule in our favor and, finally, will put an end to these un-American lawsuits,” campaign spokesman Stephen Chang said in a statement.
On January 6, 2021, the US Congress was about to confirm the results of the 2020 election, which resulted in the presidency going to Joe Biden. On this day, numerous Trump supporters gathered for a protest in the American capital. Some demonstrators broke into the Congress building and disrupted the meeting. Democratic congressmen immediately blamed Trump for the incident.
