On March 5, 2024, Colorado residents will vote in a “primary election” to determine which candidates will be able to compete for the presidency of the United States in November. In a recent decision that many are describing as “shocking news,” “an explosion” and a “moment for democracy,” the Colorado Supreme Court said no. By a 4-3 margin, the court ruled that Trump’s fate was determined by Section 3 of the Fourteenth Amendment, which prohibits “rebels” from holding federal or state office.
The court’s decision follows a lower state court’s decision that Trump engaged in riots in late 2020 and early 2021 in a knowing and willful attempt to obstruct a fair transfer of power. In addition to lying about the election results being rigged, he also incited his followers to disrupt the election vote counting and simultaneously participated in a plan to replace certified state electors with fake pro-Trump electors. The court concluded that these actions constituted active rebellion against the US Constitution.
