Cologne: restaurateur auctioned ship MS Düsseldorf, dispute in court

In the dispute over the excursion ship “MS Stadt Düsseldorf”, the Düsseldorf district court is making a new attempt. A trial date originally planned for last December is now to take place on Tuesday next week. The Cologne restaurateur Daniel Rabe and three of his family members are demanding that the “White Fleet” from Düsseldorf hand over the 51-year-old ship.

Excursion boat auctioned for 75,000 on Ebay

The plaintiffs bought the ship at an online auction on Ebay a year ago for around 75,000 euros. You are of the opinion that you have concluded a legally valid sales contract with the award. The “White Fleet Düsseldorf” as the defendant contradicts this and refuses to hand over the ship.

The ship is to be used for gastronomic purposes

The shipping company wanted to thin out the fleet after the corona-related drop in demand and part with one of its four ships. Apparently it was anything but a good deal for the provider: the engine alone is said to have been overhauled just a few years earlier for 100,000 euros, and there is talk of a hoped-for proceeds of 400,000 euros.

Daniel Rabe told the “Kölner Stadt-Anzeiger” that everything went correctly. The 41-year-old co-operator of the “Bagatellen” in Ehrenfeld, Südstadt and Sülz wants to use the ship for gastronomy together with his wife, brother-in-law and sister-in-law – not as “MS Stadt Düsseldorf”, but under the new name “MS Schang Jülich” – in honor of the deceased Cologne original Jean “Schang” Jülich, who was a member of the resistance group Edelweißpiraten during the Nazi era.
