CODAF: 2023 assessment and 2025 action plan

The Var prefect and the public prosecutor at the Toulon court of law brought together the department’s anti-fraud committee (CODAF) in a plenary meeting with the public prosecutor at the Draguignan judicial court. On the agenda for this meeting:

  • checking and verifying the results of the actions taken;
  • set the annual strategy to combat fraud and illegal activity;
  • sign a partnership agreement to combat tax and social benefit fraud.

1. The CODAF an Var: Method of use

CODAF’s mission is to help fight public financial fraud, social fraud and illegal work, tax and customs fraud.

It consists of a local network for:

  • providing a global and integrated response to the phenomena of fraud by promoting the implementation of all civil, administrative and criminal sanctions tools);
  • organize collaborations and promote the exchange of operational information;
  • improve common knowledge of fraud phenomena between services;
  • offer training and share experiences.

2. With bill 2023 du CODAF du Var

In terms of coordinated actions, 159 disciplinary operations led by two or more CODAF partners in 2023 with 94 spring activities you TJ from Toulon etc 70 on the spring you TJ from Druig-nan-ceud compared to 140 in 2022, 135 in 2021 and 89 in 2020.

AN 159 coordinated operations including the following activity categories:

  • 46 activities in local businesses (including various hairdressing salons and workshops), ie 28.9%
  • 41 activities in HCR (hotels, cafes, restaurants) and outdoor hotels, i.e. 25.8%
  • 22 jobs in road transport and VTC, ie 12.6%
  • 12 operations in the
    BTP

    Construction and public worksor 7.5%
  • 12 activity in diving and sailing clubs, ie 7.5%
  • 6 jobs in garages and car scrap yards, ie 3.7%
  • 5 jobs in agriculture and viticulture, i.e. 3.1%
  • 15 activities in different sectors (sports hall, amusement parks, etc.).

As part of the activities carried out by the DDETS, 635 interventions were also carried out on construction sites in 2023.

Coordinated activities bring together the services of the organization Dhumility betweenshare the national police, of the regional gendarmerieof the Marine Gendarmerieof the Border Policeof the Customsof the DDFiP (taxes), of the DDETS (work study), DDPP (competition, consumption and fraud prevention), DRILL (transport control), SDJS (youth and sports), USSR and the MSA.

> 2.1 Special assessment of the fight against illegal work and fraudulent posting

In 2023, CODAF moderated 87 prprocedures for illegal work.

The department of construction still overrepresented in reporting illegal activity to a tune 49 % fine in 2023. Local businesses are the second most affected sector 12% of the establishments spokenand.

Administrative sanctions for illegal work are still being implemented. Temporary closure procedures for illegal work will reach 8 in number in 2023, resulting in effective sanctions for closure periods between one week and two months. The findings were mainly aimed at food businesses, cafe/restaurant establishments and hairdressers. For 2024, eleven closing procedures already opened.

Finally in 2023, 59 dadministrative fine decisions on a report from the Var labor inspection agents they were cited by the DREETS for a total amount of € 473,411, mainly for non-compliance with the rules regarding the provision of international services (secondment) and for the lack of a professional identification work card of the business construction

> 2.2 Special assessment of fraud in social grants and benefits

The fight against fraud in social contributions and social benefits in the Var region has given those involved in this fight the opportunity to see in 2023 total amount of fraud social up to from 26,5 M€ suffering from social groups.

By discovering this fraud it will be possible to stop the payment of invalid benefits which might, otherwise, have continued over time. This avoidable damage is calculated at a rate of 6,7M€ in 2023.

The changes made by the USSRAF, especially those that are operated from all the procedures at illegal work including those who established partnership services, only representing a measure of 13,6 M€ in 2023.

3. CODAF du Var action plan for 2025

The main axes of the CODAF du Var action plan in relation to illegal work will include:

  • the organization of integrated or coordinated control activities aimed at sectors identified as local priorities, in particular the
    BTP

    Construction and public worksUNHCR, temporary work, security
  • the fight against false status
  • the fight against fraud in the international movement of workers
  • identifying and combating the worst forms of exploitation at work
  • the triptych: better sanctions, recovery and better reparations for damages related to illegal work.

4. Signature of the partnership agreement to combat tax fraud and social benefits

This agreement aims to formalize the agreementcommitment of partners to strengthen the effectiveness of actions to combat tax fraud and social benefits carried out as part of a special training from the CODAF du Var which was implemented effectively from September 2021.

Its main objectives are:

  • encouragement, by strengthening information exchange prevention of fraud when checking the right to a benefit, checking the payment of taxes and/or contributions as well as the detection and treatment of fraud;
  • increase responsibility groups through rapid information on each case of fraud identified by one of the partners;
  • improve the creation of suspicious files thanks to information, material elements or declarations collected between participants
  • share activities fight against fraud committed by the various organizations as well as thegood practices in this matter;
  • implement programs to creation common;
  • confirm effectiveness legal proceedings brought against criminals;
  • carry out complementary or concurrent records when possible;
  • delete users of the social and fiscal system to overcome the rules thanks to transparent and effective cooperation.

It translates strictly into the establishment of reporting forms, requests for information, coordinated activities, training activities, sharing of criminal policy priorities set by public prosecutors and better coordination between administrations and services legal police.

The assembly is established in strict compliance with access rights to information available to each signatory in accordance with the legislation.

Finally, there is an annex attached to the document map of the actors of the fight against tax fraud and social welfare fraud in the Var sector.

This agreement is signed between Codaf du Var partners who are represented within the executive committee to combat tax and social benefit fraud (FFPS).

Linked to that desire is the desire of those involved in the fight against tax fraud and social benefit fraud for better cooperation to better support those who need it most. This commitment is based primarily on the methods put in place by the contract between the State and the Var department within the framework of the Law of December 18, 2023 for full employment in addition to the Solidarity Agreement such as maintenance rights and obligations (the first appointment set for any new beneficiary of the
