Children in Italy should not be forced to see grandparents, according to court | Abroad

Italian children cannot be forced to see their grandparents if they do not want to. Italy’s highest court has that on Wednesday judged in a case of a family dispute.

Italy’s Supreme Court of Cassation ruled in a case brought by two parents. A lower Italian court had previously said that their children should be able to spend time with their grandparents.

The parents argued that this was undesirable in their case because of family problems. They had problems with the father’s parents. As a result, the atmosphere at family gatherings was tense. As a result, the children no longer wanted to visit their grandparents.

The Supreme Court ruled in favor of the parents. “The right of grandparents to see their grandchildren does not outweigh the right of those same grandchildren if they do not want to. Although children benefit from a good relationship with their grandparents, they cannot be forced to do so,” the court wrote. in the pronunciation.

Italy passed a law in 2006 giving children the right to contact their grandparents, even if the parents are divorced. Grandparents are allowed to start a business if parents deliberately deny them contact with their grandchildren. Then the grandchildren themselves must be open to contact.
