1. What is a Certificate of Good Conduct?
A Certificate of Good Conduct (VOG) is mandatory in childcare. A Certificate of Good Conduct is a statement showing that the employee’s judicial past does not constitute an objection to working in childcare. Justis (an organization that falls under the Ministry of Justice) processes the applications. When assessing a VOG application, Justis checks whether someone has criminal offenses to their name that pose a risk to the position or purpose for which someone is applying for the VOG.
2. Are all criminal offenses a reason to refuse a Certificate of Good Conduct?
Not all criminal offenses constitute an objection to issuing a Certificate of Good Conduct. This depends on the fact and the job for which the Certificate of Good Conduct is requested. A speeding violation may be important if the applicant wants to become a bus driver, but not for a position in childcare. If an employee does not have a criminal record or matters that are relevant to the purpose of the application, an employee will receive a Certificate of Good Conduct.
3. VOG is a snapshot, what if something happens afterwards?
Childcare employees must also be registered in the Childcare Persons Register (PRK). Justis continuously screens everyone listed in the PRK. If there is a change in the employee’s criminal record in the meantime, Justis will re-examine everything known about the person. If there is reason to do so, the service will send a signaling letter to DUO, the administrator of the PKR. DUO then informs the GGD and the GGD asks this person via the employer to reapply for a Certificate of Good Conduct.
‘An open criminal case can be a reason to send a warning letter. So it does not have to just be a conviction,” says spokesperson Roxanne Buisman of the Ministry of Justice. But a declaration alone is not a reason to send a warning letter. ‘In principle, a warning letter is sent when the changes in the documents pose a direct risk to minors. This could include an open case for a sexual offence, but also, for example, a serious violent offence.’
4. Still a Certificate of Good Conduct despite a signal?
It is not impossible that someone will still receive a Certificate of Good Conduct, despite Justis having sent a signal. The final screening takes place when the employee has applied for a Certificate of Good Conduct. The assessment also takes into account the circumstances of the case, such as the personal situation. But if a new Certificate of Good Conduct cannot be submitted within the agreed time, the employee is no longer allowed to work in childcare.
