I. f. chief prosecutor Borislav Sarafov demanded the resignation of the head of the Sofia District Prosecutor’s Office, Nevena Zartova. The reason – a case against the suspect of the double murder in Lozen, who confessed to having committed another murder a year ago. The charges against 34-year-old Chavdar Boyadjiev in this case are for causing death by negligence, the prosecutor’s office states.
Sofia district prosecutor Nevena Zartova is a candidate for European delegated prosecutor. She is one of the 17 candidates who are fighting for 7 vacancies in the structure of Laura Köveshi in Sofia. The procedure for the selection of new delegated European prosecutors in Bulgaria is pending before the Prosecutor’s College of the Supreme Judicial Council.
“Only a week ago, again on an unpleasant occasion related to serious criminal offenses, I drew attention to the fact that prosecutors must serve the citizens. Then I announced zero tolerance for all manifestations of aggression and violence, which should meet the immediate resistance of the investigative bodies, which unwaveringly apply the law with all its rigor. Zero tolerance, however, also applies to all those prosecutors and especially to administrative heads who allow a formalistic and even heartless exercise of their powers. Something that can have serious negative consequences,” Sarafov points out in statement published on the website of the public prosecution.
“Precisely because of this, I accepted with great indignation the circumstances reported to me by the Sofia City Prosecutor’s Office regarding the pre-trial proceedings conducted for the double murder near the village of Lozen, in the course of which it was established that the same person was the perpetrator of another intentional murder that took place last year , the pre-trial proceedings for which are conducted under Article 122 of the Criminal Code /for causing death due to carelessness/ in the Sofia District Prosecutor’s Office /SRP/”, he emphasizes.
And he adds: “In the context of the above and due to the admitted obvious gaps in the organization of work in the SRP, including neglect and underestimation of the investigation into the death of a young woman, which occurred on 04/06/2022 as a result of intentional violent acts and the gross mistakes, both in establishing the facts and in determining the legal qualification of the criminal act, I expect the resignation of the administrative head of this prosecutor’s office – Mrs. Nevena Zartova. Otherwise, I will use my legal powers and refer the case to the prosecutor’s office collegium of the SJC”.
He calls on the administrative heads of the prosecutor’s offices throughout the country to urgently carry out checks on all pending pre-trial proceedings related to causing death, and if necessary and in the presence of an established perpetrator, to carefully specify the charges brought forward.
“I will be uncompromising to any administrative head and to any supervising prosecutor, if unwarranted delay or unprofessional attitude is found in the investigation of crimes against the person. At the same time, I declare my full support for all colleagues who conscientiously, honestly and professionally perform their official duties in favor of of justice and civil society,” is categorical the attorney general.
