Chief Justice of the Constitutional Court Cannot Predict When Presidential Age Lawsuit Will be Decided

Chief Justice of the Constitutional Court (MK) Anwar Usman cannot determine when the lawsuit for the age of the presidential and cawapres candidates will be decided by his party. Anwar said he could not predict that.

“Just wait because there is still a process, the parties are still submitting experts and witnesses. So the Constitutional Court is faster when the parties limit the submission of witnesses or experts,” said Anwar at the RI MPR Building, Friday (18/8/2023).

Anwar said there was no definite date for the end of the lawsuit for the presidential and vice presidential candidates. he said the process at the Court was still presenting witnesses and experts.

“That depends on the parties, both the DPR and the government, especially the applicant,” said Anwar.

“It’s difficult to predict. What is certain is that the parties will present experts and witnesses,” he said, answering when the lawsuit for the age of the vice presidential candidate was decided.

As is known, a number of Indonesian citizens submitted a request for a judicial review of Article 169 letter q of the Election Law against the 1945 Constitution. This article states that the minimum age requirement to become a presidential/cawapres candidate is 40 years. The application was registered (page of the Constitutional Court) dated March 16, 2023 under number 29/PPU-XXI/2023. Then another applicant dated May 17 2023 with number 55/PPU-XXI/2023.

The plaintiffs asked for the minimum age for presidential and vice presidential candidates to be 35 years. Then there are also those who ask for the minimum age for presidential and cawapres candidates to be 25 years and 21 years.

The judicial review of this matter is currently still ongoing at the Constitutional Court. Chief Justice of the Constitutional Court Anwar Usman said that currently the trial of the case was still at the stage of proof.

“It’s still being processed, it’s still being proven at the next trial,” said Anwar at the Presidential Palace Complex, Central Jakarta, Monday (14/8).
