Law of October 27, 2022 on emergency measures to limit electricity prices and the support of some consumers, in 2023 it introduces maximum pricing mechanisms for the electricity consumed in agreements with entitled consumers. Under the law, eligible recipients are businesses (SMEs), but also households and so-called sensitive recipients.

For which companies is electricity cheaper?

Entrepreneurs are entitled to cheaper electricity in 2023 micro, small or medium enterprise pursuant to art. 7 sec. 1 points 1-3 of the law of 6 March 2018 – Law of entrepreneurs (Official Gazette of 2021, articles 162 and 2105 and of 2022, articles 24, 974 and 1570), to the extent that consumes electricity for its core business.

Terms used in the law mean:

1. micro-entrepreneur – an entrepreneur who has met all of the following conditions in at least one of the last two years:

• employed fewer than 10 people on average per year, e
• has had an annual net turnover from the sale of goods, products and services and from financial transactions that does not exceed the PLN equivalent of EUR 2 million, or the total assets of its balance sheet drawn up at the end of one of these years has not exceeded the PLN equivalent of EUR 2 million;

2. small business owner – an entrepreneur who has met all of the following conditions in at least one of the last two years:

• employed on average less than 50 employees per year,
• has had an annual net turnover from the sale of goods, products and services and from financial transactions that does not exceed the PLN equivalent of EUR 10 million, or the total assets of its balance sheet drawn up at the end of one of these years has not exceeded the PLN equivalent of EUR 10 million
• and who is not a micro-entrepreneur;

3. average entrepreneur – an entrepreneur who has met all of the following conditions in at least one of the last two years:

• employed on average less than 250 employees per year,
• has had an annual net turnover from the sale of goods, products and services and from financial transactions that does not exceed the PLN equivalent of EUR 50 million, or the total assets of its balance sheet drawn up at the end of one of these years has not exceeded the PLN equivalent of EUR 43 million,
• and who is not a micro or small entrepreneur.

How much will companies pay for electricity?

The law provides for its use in agreements with companies the maximum electricity price is 785 PLN per MWh compared to consumption from 1 December 2022 to 31 December 2023. VAT and excise duties must be added to this price according to the rates in force.

If the electricity sales contract was concluded after February 23, 2022, the maximum price also applies in the period from the date of conclusion of the contract to November 30, 2022.

How to apply for the cheapest electricity?

The declaration must be submitted to your electricity supplier: Tauron. PGE, Enea, Energa, E.ON. The application can be submitted:

• on line, to the e-mail address of the electricity supplier. The application must have a qualified electronic signature, a trusted signature or a personal signature (e-ID certificate). It is important to remember that before signing the document, first save it in pdf format, then sign it electronically and send it to the indicated email address. According to the regulation, the application cannot be submitted in the form of a scan or photo,

• to send – the application must be printed, signed by hand and sent to the operator’s address,

• in person at the customer service point energy company.

How to fill out an application for the cheapest electricity for your business?

The application must include:

• name, registered office address, PIN or PESEL number, telephone number or e-mail address,
• contact details of up to two natural persons who are: the authorized recipient or his representative (attorney, board member of a limited liability company, etc.),
• Electricity Consumption Point (DPI) number,
• the category of eligible recipient,
• date of conclusion of the energy sales contract or the global contract for each DPI,
• amount of electricity consumed (data used to determine the estimated part of electricity that will be used for the purposes indicated in article 5, paragraph 1, paragraph 2, letters a) and b) of the law); the fields in column 4 should be supplemented with numerical data on the estimated volume of electricity that will be used in a given EPP in the period from 1 December 2022 to 31 December 2023,
• percentage data on the amount of electricity of a given DPI used for purposes covered by the maximum price and not covered by this price. In the last two columns of the table (5 and 6) the value shown in column 4 must be broken down by inserting the percentage data that the entrepreneur intends to use within the maximum price and beyond the limit; the sum of these data must be 100%.

When must the application be submitted? Deadlines

The application must be submitted until November 30th. The document can also be presented after that date, but the energy company will apply the maximum electricity price starting from the month following the one in which the application was presented.
