The Ministry of Communication and Informatics (Kominfo) appealed to owners ChatGPT to immediately register their services as Electronic System Operators (PSE). If not registered in Indonesia, ChatGPT has the potential to be blocked.
ChatGPT has become phenomenal in recent weeks because of its sophistication as a chatbot that utilizes Artificial Intelligence (AI) technology.
When asked about the existence of ChatGPT to the Director General of Informatics Applications (Dirjen Aptika) of the Ministry of Communication and Informatics, Semuel Abrijani Pangerapan, revealed that his party still did not know the ins and outs of ChatGPT, including the obligation to register as a PSE.
“I don’t know whether (ChatGPT) is paid or not. What is the application, including the six categories (which are required to register for PSE) or not,” said Semuel when met after the Digital Literacy Kickoff event at Menara Danareksa, Jakarta, Thursday evening (23/4/ 2023).
For information, Open AI as the owner of the ChatGPT service provides it for free. However, there is also a shared version of ChatGPT or ChatGPT Plus which costs USD 20 or around Rp. 300 thousand per month, which is the premium version which is already available in Indonesia.
Knowing things ChatGPT there is a paid version, Semuel requested that the digital platform register itself as a PSE with Kominfo.
“Oh yes (paid ChatGPT) means you have to register. Later we will see if he has entered targeting Indonesia yet, if he is targeting us, we will send a letter to register for PSE,” he said.
“There are transaction services that must be mandatory, there are paid services, then there are finances, then there are search engines, and there are more, especially I forgot, finally collecting personal data of Indonesians. There are six categories, we’ll see later (ChatGPT in Indonesia),” he continued.
Asked further, whether Open AI had registered itself as a PSE with Kominfo, the man who is called Semmy said that his party had not received any reports regarding ChatGPT being registered.
“There is no (communication). We haven’t analyzed it, we will analyze it,” he concluded.
As previously reported, digital platforms operating in Indonesia are required to register as PSE with Kominfo. If it is not registered, blocking will be the consequence.
The search engine Yahoo, Steam, Dota, Counter-Strike, Epic Games, Origin.com, Xandr.com, and PayPal saw the PSE rule blocked in the last year.
Parties who are required to register for PSE are listed as in PP Number 71 of 2019 (PP 71/2019), PSE registration must be carried out by every party that organizes electronic systems in Indonesia, both from the state (public bodies) and private parties.
In PP 71/2019, PSE itself is divided into two categories, namely Private PSE and Public PSE.
The meaning of the six categories of PSE Private Scope referred to by Semmy above is in accordance with the PSE rules, namely:
– Provide, manage and/or operate the offering and/or trading of goods and/or services
– Provide, manage and/or operate financial transaction services
– Delivery of paid digital material/content via data networks, either by downloading via portals or websites, sending via electronic voice, or via other applications to user devices
– Provide, manage, and/or operate communication services, including but not limited to short messages, voice calls, video calls, electronic mail, and online conversations in the form of digital platforms, networking services, and social media
– Search engine services, services for providing electronic information in the form of writing, sound, images, animation, music, videos, films and games or a combination of some and/or all of them; and/or
– Processing of personal data for operational activities serving the public related to electronic transaction activities.
