The earthquake that is shaking the Juventus following the closure of the Prisma investigation and the request for indictment by the Public Prosecutor’s Office of Turin against the club, the president Agnelli, the vice-president Nedved, the former sports director Paratici and 10 other members will inevitably also involve the sports justice system which has opened a new line of inquiry linked to the hypothesis of a crime of forgery in budget. The so-called “Stipendi Manuve” are the key point around which many of the crime hypotheses revolve which do not lead to the capital gains issue, currently already filed in two degrees by the federal judges.
ARTICLE 94 AND ARTICLE 31 – If the ‘Wage Maneuver’ is the key to the prosecution, article 94 of the Noif FIGC (federal internal organizational rules) and article 31 of the Code of Justice are the two key regulations for understanding what is at risk the company in the event of proven guilt. WHAT IS JUVE AT RISK? – So what does Juventus risk if the offense is confirmed? If the hypothesis of false accounting cannot lead to penalties up to relegation, unless it is aimed at obtaining registration in the championships, on the contrary if the non-regularity of the “Salary Maneuver” is confirmed Article 31 PARAGRAPH 6 of the Sports Justice Code would also open up to the possibility of penalisation: “The company that makes agreements with its members or pays them compensation, prizes or indemnities in violation of the federal provisions in force, is punished with a fine ranging from one to three times the amount illegally agreed or paid, to which the penalty of one or more points in the standings may be added”.
WHAT ARE PLAYERS AT RISK? – Having ascertained what Juventus risks, however, there is another aspect to take into consideration e it also concerns the players themselves who agreed and signed that Maneuver. And this time it is Paragraph 11 of Article 31 that clarifies the risks for registered players (therefore players) who are guilty of an offence: “Members who enter into an agreement with the club or in any case receive compensation, bonuses or allowances from it in violation of federal regulations, are subject to disqualification for not less than one month”.
