However, this decision did not stop Law and Justice. On Thursday evening, out of nowhere, Marek Suski appeared with his bill. A project withdrawn a moment earlier by MP Emilewicz. The Sejm adopted a swift procedure of work and adopted the act – by the votes of the United Right – on Friday.

225 deputies voted in favor of the bill, 212 were against, and one deputy abstained from voting. Moments earlier, the deputies rejected the motion of the KO club to reject the bill in its entirety.

The bill will now go to the Senate. It is to apply from April 1, 2022.

Change of the billing system

The act introduces the so-called net billing. According to this mechanism, prosumers will be obliged to sell the surplus energy that they feed into the grid. At the same time, when their energy demand will be greater than their production from photovoltaic panels (e.g. in winter), they will pay for it in the same way as other electricity consumers.

In addition, they will also pay for distribution, with the difference that they will be entitled to a 15% discount on distribution variable charges for energy fed into the grid and stored there by non-entrepreneurs and persons.

The Ministry of Climate and Environment has been announcing the proposed changes in the settlement system for prosumers and network operators for some time, and in May 2021, it went from word to point and presented the draft act.

In July, Jadwiga Emilewicz proposed her bill, which was slightly milder for prosumers. And it was precisely her project that the Sejm dealt with in the first place.

The new energy system

The ministry explained the necessity to introduce changes by the fact that the number of prosumers is growing rapidly, and thus the load on power networks is also growing (especially low voltage ones).

In addition, Poland must implement EU directives that oblige member states, inter alia, to introduce solutions in which all recipients pay appropriate network fees and to settle, inter alia, prosumers separately for energy input and downloaded from the web.

Currently, settlement is made on one account. While a separate settlement must take effect on January 1, 2024 at the latest, a different one requirements must be introduced in advance.

Today, prosumers producing energy in installations up to 10 kWp pay a fee of 1 to 0.8. For one unit of energy fed into the grid, they can download 0.8 for free. For larger installations (above 10 kWp) this ratio is 1 to 0.7. It is a net metering system that uses the discount mechanism.
