From Saturday, September 19, there are many changes in the so-called construction. Their goal is to simplify and accelerate investment processes in construction. All because of the amendment to the construction law.

The change in regulations is to translate into an increase in the number of flats delivered, as well as the disappearance of absurdities, such as the need to obtain a building permit in the case of installing ATMs, parcel machines or other such devices.

Deputy Prime Minister and Minister of Development Jadwiga Emilewicz argues that the acceleration and simplification of procedures will result in the fact that flats and houses will be delivered to citizens in a shorter time.

On the other hand, as Deputy Minister of Development Robert Nowicki explains, the excessive number of documents, which are now required at the very beginning of the investment, extends the construction process. He adds that after the amendment enters into force, the technical design may be executed after obtaining the building permit, but before the commencement of construction works. He emphasizes that it will be the responsibility of the construction manager to have an up-to-date technical design on the construction site, and the designer will submit a declaration of its correctness and preparation prior to the commencement of construction works.

You will not need a building permit to set up an ATM

The new regulations also introduce a simplified process of legalizing the old illegal construction. Thanks to this – as mentioned – construction supervision will obtain information about their existence and will be able to check their safety.

The owner will avoid the legalization fee if he reports to the construction supervision a construction permit – at least 20 years old – and presents a technical expertise confirming the possibility of safe use of the object and a geodetic as-built inventory

The new regulations also eliminate absurdities such as the need to obtain building permits for ticket machines, cash deposit machines, vending machines, parcel machines or machines used to perform other types of services. All these devices up to a height of 3 m inclusive will be exempt from the building permit and notification obligation.

The act introduces a five-year deadline for annulment of the building permit and the occupancy permit. Until now, as explained, the invalidity of the building permit could be declared many years after the building was built and used. “The new solutions will mean that 5 years after the decision has been delivered or announced, it will not be possible to move it” – it was written.
