Change the construction law, planners called on the ministry – News

The new digital systems have been criticized by builders and officials since they were launched on 1 July. The new law requires applications for building permits to be submitted directly digitally. The changes were supposed to lead to a significant acceleration of building permits. Instead, in the past weeks, they made the job more complicated.

The chamber warns that a change in the law is needed so that builders and developers of project documents do not have to create new documents and re-sign contracts that have already been completed.

According to ČKAIT, it would otherwise be necessary, due to possible delays and sanctions for non-compliance with deadlines, to conclude a new agreement on the dates and scope of the performance.

“We are aware of several cases where, before June 30, 2024, according to the legal regulations in force at the time, preparations were initiated or project documents were developed for construction contracts and contractual relationships were terminated. However, they can no longer be completed according to the old Building Act valid at the time and its implementing regulations. All the work, and the related costs, can then start anew,” said Eva Kuzmová, legal expert at ČKAIT.

According to Minister of Regional Development Ivan Bartoš (Pirates), the step requested by ČKAIT is not possible. “The use of the processes according to the old construction law does not give material meaning, because the process would not be simplified,” he said.

The Chamber also requests that, during the transition period, which will last until June 30, 2027, it is not necessary to submit the project documents or the building permit documents to the electronic document register through the Person’s Portal -build along with submitting the application.

Bartoš said in a recent interview for Novinky that builders already have this option. The officers themselves then upload it to the new systems. Now he said, in his opinion, builders will continue to submit documents prepared according to the old construction law for some time to come. They will also be able to enter it in a paper form or through a data box.

The office has long refused to change the law. They believe that they will correct the fundamental defects in digitization by the end of August.
