With a little less than a week to go before the debate on the death of young Diego Pachao, his mother, who is promoting the lawsuit, changed his legal representative.

The woman is now represented by the lawyer Natalia Soledad Rodríguez. According to the judicial agenda, the start of the oral and public debate is scheduled for this Monday, August 8. The dock of the accused will be occupied by six policemen.

The death of Pachado, 20 years old, was recorded on March 14, 2012. Two days earlier he had been admitted to the San Juan Bautista Hospital in critical condition, transferred from the Seventh Police Station, in the northern part of the Capital, where he had been arrested. . For this fact, the police officers Gustavo Eduardo Bulacios, Ricardo Darío Barrera, Ricardo Javier Varela, Jorge Duilio Montivero and Claudio Yani Nieva were charged with “insults” and “failure to comply with the duties of a public official” and Ramón Ariel Quevedo, only for the latter crime.

At the end of April, the trial offer stage was completed. Both the Chamber Prosecutor’s Office and some defenders offered the pertinent evidence.

However, the lawyers for the lawsuit – at that time represented by lawyers José Furque and Beatriz Monllau – did not make any presentations. Regarding the terms of this procedural instance, it was indicated that from the last notification, they run 10 days in a row. After the term expired, the complaint –represented by the lawyers José Furque and Beatriz Monllau- was presented in Court but without the possibility of incorporating the evidence. The complaint, promoted by the mother of the deceased young man, always supported the hypothesis of “torture followed by death.” However, their representatives did not present the evidence supporting this idea in a timely manner.
After this instance, the evidence offered by the Chamber Prosecutor’s Office, at that time in charge of the prosecutor Ezequiel Walther, as well as by the defense attorneys, was processed. Once these stages were completed, in mid-June, the Court set a date for the debate for August 8.
Prescription
In 2012, the Juvenile Criminal Judge Rodrigo Morabito declared the prescription and dismissal of the Leiva brothers, suspected of having beaten Diego Pachao, which resulted in the death of the young man. The ruling was issued almost a month after the Criminal Chamber No. 2 resolved that the case for “preterintentional homicide” be tried in the Juvenile Criminal Court, since one of the defendants at the time of the events was a minor.
The brothers had beaten Pachado in a street fight. The young man was arrested at the Seventh Police Station, where he would not have received the corresponding care.
