The Central government has questioned the admissibility of fugitive Zakir Naik’s plea seeking clubbing of 2013 FIRs related to hate speeches in Maharashtra, Karnataka and elsewhere. The Center said how can a fugitive person seek linking with the FIR citing the situation.

Solicitor General Tushar Mehta, before a bench of Justice Abhay S Oka, asked whether a person who has been declared a fugitive can file a petition under Article 32 of the Constitution. Mehta said that he is ready with the counter affidavit. Naik’s lawyer said the matter pertains to clubbing the FIRs together. He has no instructions regarding withdrawal of the petition.

The bench asked Naik’s counsel to file an affidavit of the petitioner stating whether he wants to pursue it or withdraw it. The bench said, the Solicitor General can file a counter affidavit. There will be a hearing in this matter next week. In the year 2013, several cases were registered against Zakir Naik across the country and three in Maharashtra for hurting religious sentiments.

43 FIRs are registered in different states

The lawyer appearing for Naik said that he has not received any instructions regarding withdrawal of the case and the petition sought to club around 43 FIRs filed in different states. The lawyer said that six FIRs were pending against his client and he would approach the High Court to quash them.

Supreme Court seeks answer from Naik’s lawyer

The Supreme Court directed Naik’s lawyer to file an affidavit stating whether he would continue the case or withdraw it. Along with this, the court asked Mehta to file a reply in the case. The next hearing of the case will be on October 23. Naik is currently abroad. The NIA is also investigating his involvement in alleged terrorist activities.
