The Constitutional Court of Romania, on Monday evening, published the decision regarding the rejection of Diana Iovanovici-Şoşoacă’s candidacy for the position of President of Romania. “The court notes that, in relation to the acts and facts described by the appellants and mentioned in paragraphs 7-14 and 22 of this decision, registration Miss Diana Iovanovici Şoşoacă is applying for the elections for the President of Romania in 2024. the eligibility conditions provided by the constitutional provisions of art.1 par.(3) and (5), of art.82 par.(2), related to the conditions of art.148 and 149, with reference to the values ​​of democracy, the rule of law, respect for the Constitution related to their political-military commitment, half of Romania’s membership in the EU and NATO. Therefore, the Court will accept the appeals and dismiss the Decision of the Central Election Bureau number 18/D on October 3, 2024”, the document says.

According to CCR, “The right to be elected is a fundamental right of a political nature, it represents the democratic situation qua non and the democratic functioning of the state and is exercised in accordance with the requirements of the Constitution and the laws. . The right to be elected does not have an absolute character, with the possibility of being subject to restrictions, and the arrangement is the result of the democratic vision of the Constitution”.

“Even if an oath of allegiance is submitted by the candidate who wins the elections, the elements in the oath of allegiance are eligibility and meaningful conditions for running for the office of President of Romania, which must be completed by the applicant at the time of application. his application. These conditions can only be reviewed by the Constitutional Court. “It is well known that, through her constant speech, Mrs. Diana Iovanovici Sosoacă urges to change the democratic foundations of the state and to break the constitutional order,” the document says.

“Democratic rules apply to all citizens, regardless of their status in the state and political preferences, and anarchic demonstrations and slips in public space cannot be tolerated. Such behavior will include a discussion of the problem of using constitutional institutions and procedures to reject the demands, principles and values ​​that are regulated by the constitution. Public statements, taking positions and expressing declarations that go against constitutional values ​​and the demands of a democratic society, together with participation in certain public events, are reasons to enough to state that Mrs. Diana Iovanovici-Şoşoacă, as a candidate for the position. of the President of Romania, questioning and avoiding the duty to respect the Constitution through his public speech regarding the removal of essential guarantees about the fundamental values ​​and preferences of the state, is that is the status of a member state of the EU and NATO. The judges of the Constitutional Court, on Saturday, October 5, refused Diana Sosoacă’s candidacy in the presidential elections.

Monday, Diana Sosoacă paid tribute to the former legionnaire commander Corneliu Zelea Codreanu and he promoted anti-Semitism. Sosoacă made a live intervention on the YouTube page of his party colleague Luis Lazarus and paid tribute to the ex-leader of the Legionary Movement from the interwar period.
