A Cavese toy library convicted following discriminatory conduct carried out to the detriment of one little girl with down syndrome. She had, in fact, been denied the ability to play together with all the other children simply due to her disability. The denial of access to the little girl seven years ago was justified «only by the absence of suitable personnel to supervise the minor suffering from Down syndrome and highlighting that no discriminatory behavior had been carried out».
The sentence
Ma Filomena Avaglianomother of the little girl who was 9 years old at the time, together with her father considered the episode highly discriminatory and to obtain justice they turned to the court of Lower Nocerawith the assistance of a lawyer Pippo Zarrella. The sentence was published a few days ago and condemned the playroom, recognizing that «the discriminatory conduct consisting in denying the minor’s permanence within the playroom». The owner of the children’s room was also sentenced to pay compensation of 3mila euro in addition to court costs.
