Catering Manager Sues Oostappen Group for Unpaid Overtime: Boss Accuses Him of Lying and Cheating

Twenty-four hours a day, seven days a week. So often, catering manager Samir would have to be ready for his boss Peter Gillis. But his overtime at Prinsenmeer Park was not paid, so he went to court and demanded 180,000 euros from the Oostappen Group. Oostappen boss Gillis does not agree with this. He accuses his employee of lying and cheating.

For example, Samir is said to have called in sick while he was working in a shawarma shop in Breda. The case between Samir, known from the real-life soap opera around Peter Gillis Massa is Kassa, was brought before the court in Eindhoven on Wednesday.

‘Used as a slave’
The catering manager’s complaint boils down to this: too much overtime, too little money and never a day off, let alone a holiday. Samir would always have to be ready for his boss, worked from ten in the morning until one at night. And then the cash register also had to be made up and the place cleaned. Everything had to be sent to the boss by email. “Then I get an answer from Mr. Gillis at three o’clock in the morning. Either he says ‘well done’, or he says ‘everything is going to hell’,” Samir indicates.

Gillis would say the latter more often. If the music was not on on the terrace, Gillis would call from his holiday address, Samir’s lawyer argued in court. And even out of season he had to be present for special parties in the park and drinks for the staff. During the corona period, there was an illegal party in a warehouse, ‘out of sight of the government’, it turns out. “Samir was used as a slave,” Nicol Kremers, Gillis’ ex, previously stated. Her statement and that of several ex-employees are discussed in court.

Organize your own time
Gillis sees it differently. The bond between him and Samir was very good, Samir lived in the park and was given plenty of space to manage his own time. That is why all those overtime hours have not been recorded, because they could easily be compensated in the winter. According to the entrepreneur, this is how it has been working at Prinsenmeer for years and that is how it works for all staff.

He contradicts that winter is filled with parties. With a few days’ work a week, the catering manager could easily keep up and a three-week holiday to Egypt was no problem. “We had a good time together, he was always there for us. Everything was done in confidence,” says Gillis.

Shawarma place
What is a problem according to the Oostappen boss: that Samir was often on the phone in his car and sometimes did not show up for work at all. What bothers Gilles most is that Samir called in sick and then went to work at night in a shawarma place in Breda. Gillis saw a video of it and things haven’t worked out between the two since. A call from the judge to discuss the matter together on Wednesday failed after half an hour.

It is not yet clear when a decision will be made.
