Capitol car dealership illegally uses municipal land, the court ruled – Bulgaria

The owner of the capital’s Capitol car dealership, located in Borisova Gradina, is illegally using the land and must hand it over to the municipal company Sofiyski Imoti EAD. This follows from a ruling by the Supreme Court of Cassation, which has refused to hear the case, Sega reported.

In this situation, the decision of the Sofia City Court enters into force, which is in favor of the municipal company. The mayor’s office does not owe any penalties to the tenant, who has invested in the site, building reinforced concrete foundations with an umbrella of metal construction. They are implemented without a building permit and without approved projects.

According to the terms of the contract, they will either be removed or will remain the property of the landlord.

In the meantime, however, the land was transferred to another company – ET “Minkin – Albena Minkin”. The director of Sofia Properties Dimitar Shivachev explained to BGNES that in this situation the company cannot take advantage of the court’s decision, as the tenants have filed a new case in the Sofia City Court and the first hearing is scheduled for October.

Shivachev explained that the Capitol saga has been going on for about three years and explained that until receiving the letter to vacate the land, the owners had regularly paid rent. He added that the car dealership has the main building, which is located in the area and when it is vacated it will have to be expropriated.
