Can you sell excess electricity generated? And is there already legislation for this? Bouwsite Livios shows you the ropes.

Theory versus practice

Purely theoretically, it is perfectly possible to make a private charging station available to the public for a fee. In practice, however, it is a lot more complicated. “In principle, electricity generated from smart charging stations can also be sold between private individuals,” explains Jochen De Smet, chairman of EV Belgium. “There are, however, some gaps. For example, you normally need a supply permit to sell electricity. Grid operators Engie and Fluvius, for example, have this.”

“In addition, there are many matters that have not yet been legally finalized. For example, there is no consensus yet as to whether VAT should be charged, and what percentage that rate should be.”

The chairman of EVB stated that he is not against the private sale of electricity: “I would like to make it clear that we see potential in trade between private individuals, but not in every form and there must be a clear legal framework. We see many other future options that we are in favor of. Consider producing and selling energy together, so that families can act collectively as an energy community.”

No correct legislative framework

According to De Smet, the reason that the framework for energy communities is currently not working optimally is quite clear: “You actually have to pay twice. A private individual pays for the injection on the one hand, but also taxes and network rates on the other. Therefore it is currently not profitable. In our view it is possible, but there is no appropriate legal framework that allows it in a flexible manner. It is therefore not advisable to sell energy in this way.”

Better alternative?

What are they fans of at EV Belgium? “We are currently more likely to see music in public domains and semi-public loading. There is no longer a shortage of smart charging stations in our country: integrating a system in which a private individual sells electricity to another private individual seems unnecessary to us.”
