A California court has ordered the release of documents from Roman Polanski’s rape case that, according to the fugitive director, would prove flaws in his judicial process.
Polanski was accused in 1977 of having drugged, given alcohol and raped Samantha Gailey, then 13 years old.
The Los Angeles district attorney’s office said in a statement that transcripts from former Attorney General Roger Gunson, who was originally in charge of the case, will be released.
It is unknown when the documents will be published, said the Prosecutor’s Office that celebrated the announcement that comes two days after withdrawing its objection to this request.
“We are pleased that the appeals court agrees with the victim and with our firm on the need for transparency,” Los Angeles Attorney General George Gascon said in a statement.
The Franco-Polish director was arrested in 1977 for this accusation.
To spare the teenager the legal experience, prosecutors dropped the most serious charges in a deal under which Polanski pleaded guilty to having sex with a minor.
He served 42 days in prison while undergoing a psychiatric evaluation.
But when it seemed that the judge, Laurence Rittenband, was going to reconsider and hand down a much longer prison sentence, Polanski fled to France, where he lives.
The famed director has not returned to the United States since.
Polanski requested that the transcripts be unsealed “several years ago” to investigate “alleged judicial misconduct,” according to the Los Angeles District Attorney’s Office.
However, The Hollywood Reporter magazine claims that this new request did not come from Polanski, but from two journalists.
Gailey publicly pardoned the director in 1997, saying that the treatment he received from the press and the judicial system was worse than the crime itself.
She has also requested that the transcripts be made public.
“The victim has been notified of the court’s decision and is very grateful to see that they agreed with our position, as well as the support of the attorney general’s office,” said the prosecutor, who maintains that Polanski must submit to justice in the United States. Joined.
