Cabinet is appealing asylum seekers asylum seekers granted family reunification cases

The government appealed this decision to the State Council different claims of judges allowing asylum seekers with residence permits to bring their families to the Netherlands.

The asylum seekers obtained their application yesterday in the courts of Haarlem and Breda, despite a temporary halt to this so-called family reunification.

Status holders, i.e. asylum seekers with a residence permit, can only bring their family members to the Netherlands after they have found a home in the Netherlands, the government decided in August. If this has not been successful fifteen months after their application, the family members will still receive a visa.

Discussion

Discussions immediately arose about the legal sustainability of this new provision. Asylum lawyers have emphasized the right to family reunification. Several asylum seekers with permits have gone to court to have their families come. So far three of them have been right.

“By appeal, the cabinet wants to obtain clarity from the highest authority whether the temporary measure is legally possible or not,” said a spokesman for the Ministry of Justice and Security.

The provision for family reunification falls within the a series of measures with which the government wants to solve the asylum crisis.
