On election day on Sunday, Berliners are also called upon to vote on the expropriation of large housing companies. Battis sees the proposal as a disproportionate interference with private property and a violation of the principle of equality.
In addition, the state of Berlin lacks the legislative competence for a suitability law, it said. Battis also see an inadmissible circumvention of the debt brake if an institution under public law takes out the loans to compensate the housing companies.
