The Supreme Court (MA) has reduced the sentence of Munarman, the accused of terrorism. The Supreme Court sent 5 of its Chief Justices to try Munarman.
The case started when the police arrested Munarman on suspicion of terrorism. He then legally tried and tried in the South Jakarta District Court.
At the trial, the prosecutor requested that Munarman be jailed for 8 years. In April 2022, the East Jakarta District Court decided that Munarman had been legally proved guilty of committing a crime of terrorism. The East Jakarta District Court sentenced Munarman to 3 years’ imprisonment.
The East Jakarta District Court found Munarman guilty of violating Article 13C of the Criminal Acts of Terrorism Elimination Act. For this, Munarman appealed and his sentence was increased to 4 years in prison. The Jakarta High Court (PT) found that the sentence handed down by the East Jakarta District Court was too light, disproportionate and did not respond to the sense of justice in society.
PT Jakarta also said that in determining the punishment for Munarman, the judge must pay attention to the motives and objectives of the crime, the inner attitude of Munarman, the consequences caused by the crime, i.e. allow the act of allegiance to a Islamic leader, Abu Bakar Albaghdadi Alquraisy Alhusaini, is very dangerous, because it creates order and security in society and it is prohibited by law, and public opinion about terrorism is very scary.
