Bus driver to file complaint against Stib absenteeism plan

A letter contesting the dismissal of a bus driver has been sent to Stib and a complaint will be filed for prosecution before the labor court as soon as the file is complete, said Wednesday Olivier Rittweger de Moor, member of the Council of company and CPPT of Stib.

Behind this individual procedure, it is the absenteeism plan of the Brussels public transport company which is questioned here. Jaime L. O., who joined Stib in 2008, was laid off in early January. He was the victim of a work accident in 2011, namely a return to the steering wheel caused by a hole in the road, which earned him a first hand operation. He then had potentially cancerous polyps in the stomach. In 2017, the ligaments in his hand broke and he had to be operated again.

“During this period, during the ‘absenteeism’ interviews, I had to sign papers in which I undertook not to fall ill any more,” advises Jaime LO. “My file is exemplary, if not these illnesses which are I was kicked out on the grounds that I had not respected my commitment not to fall sick anymore and that I disorganized the Stib schedule. At no time was I offered a position suited to my condition health, which would have allowed me to come to work. “

Jaime L. O. hopes to be reinstated, but more broadly wants to put an end to what he considers to be abuses of the absenteeism plan which infringe on workers’ rights. “We hope that the Stib will be condemned for unfair dismissal and that this will set a precedent for the next files”, explains Olivier Rittweger de Moor. “It is imperative that this absenteeism plan be withdrawn. Every day, drivers take their services while they are suffering because they were put under pressure and were forced to sign documents in the absenteeism interviews. we risk accidents. “
