In a new revelation within the complex framework of the “Explosion Case”, the “High Command” edge becomes the epicenter of the controversy. The plaintiff lawyer, Luis Mariano Rendón, today presented an appeal before the 7th Guarantee Court, requesting that the Prosecutor’s Office establish a deadline to formalize former president Sebastián Piñera.

This legal movement adds to the series of events surrounding the cases linked to the Social Outbreak in Chile. It should be noted that on the same side the formalization of the former general director of Carabineros, Mario Rozas, and the current general director, Ricardo Yáñez, has already been scheduled.

Luis Mariano Rendón expressed his concern about the apparent lack of legal action against key political leaders. In his statements, the lawyer argued that the current Constitution grants the President of the Republic direct responsibility for “everything that aims to preserve public order.” In this context, he pointed out that Sebastián Piñera had the constitutional authority to put an end to the cases of eye mutilation that occurred during the Social Outbreak.

Rendón highlighted Piñera’s omissive responsibility, arguing that the Penal Code sanctions those who, having the necessary power or authority, do not prevent human rights violations. In this sense, the lawyer highlighted the correct decision of the Public Ministry to formalize Rozas and Yáñez, but expressed his confusion at the absence of a similar action against Piñera.

“If this is not corrected, we would be facing a new case of impunity of the highest political leaders, which has been the trend in Chile in the last 50 years, both in terms of repressive crimes and corruption,” the lawyer concluded.

In this context, an excerpt from the appeal presented by Luis Mariano Rendón is attached, detailing the legal arguments that support his request for formalization against Sebastián Piñera.
