Bulgaria’s Constitutional Chaos: Analysis by Former Judge Georgi Markov

And while the political class had panicked if none of the candidates in question on the list, called by Hristo Ivanov menu, had agreed to take power, the Constitutional Court, referred to the same changes, continues its silence. For some it is expected, for others – mysterious.

What is the constitutional chaos, created by Hristo Ivanov and the group around him, supported in the plenary hall by GERB and DPS, and can it be fixed – comment by former constitutional judge Georgi Markov.

– Mr. Markov, on June 10, 1990, the first free and democratic elections for the Grand National Assembly were held. Then you become a deputy of the SDS, elected by a majority in the first round. Now on June 10th we will wake up to another botched election that you predicted and guessed. How far have we brought parliamentary democracy after 34 years?

– Then 92% of voters voted. The ballots were colored – the battle was between the blue and red ballots. Out of 400 deputies, 200 were elected by a majority. It was absurd for someone to say that we will vote with machines. They were going to hang him on the eagles of the Eagle Bridge. People did not go to the cinema and match to watch the Grand National Assembly until 3 o’clock in the middle of the night. SDS and BSP were very strong – they had over 5 million voters in total.

Activity will probably be about 60% lower now. The machines switch the ballots to have ala-bala. The parties are very weak. The battle will be for 600,000 votes, which are only available for GERB. “Vazrazhdane” and DPS will fight for over 300,000, which could not be entered in the Great National Assembly. No one watches the parliament, because only criminal chronicles are heard. PPDB caused cretinization of the Bulgarian parliamentary democracy!

– Meaning?

– For the first time in the history of the Bulgarian state, from the rostrum of the National Assembly, a man named Hristo Ivanov shouted that there is a constitutional obligation for certain persons to become acting prime minister. To repeat – it is a constitutional obligation to be prime minister! Thus, the obliged persons were called menu.

There was also a hepten infantile proposal – that the presidents of the Supreme Court and Supreme Court should also be on the menu for official prime ministers.

An ordinary National Assembly usurped the functions of a Grand National Assembly and unconstitutionally cut the powers of a directly elected head of state.

Boyko is right that Hristo Ivanov did nothing wrong. It was cool – it was seen how much this legal zero can do and how much the partisans of Soros from the PPDB can do.

Therefore, if Mitko Glavchev had refused to become acting prime minister, no one in the state could say what would happen next. And “America for Bulgaria” didn’t even know. Vankata Krastev and Magnitsky could not say either.

But Mitko jumped in to save the day. The man is a patriot! On March 3, he called me from Musala, he was proud that he stuck the Bulgarian flag on the top.

– OK, but why didn’t the Constitutional Court intervene? Obviously, there is no body in Bulgaria that ensures the rule of law. Are they afraid of Magnitsky?

– The Institution of the Constitutional Court was crossed out by Hristo Ivanov and company because they refused to implement the Interpretative Decision of the Constitutional Court No. 3 of 2003, which is absolutely mandatory and according to it, the National Assembly cannot close the SJC and touch the powers of the President.

Thus, the Constitutional Court in a normal country had to rule in a flash and cancel the Constitution of the communist offspring of the Comintern, Hristo Ivanov.

The Constitutional Court is not afraid of Magnitsky. All judges have over 15 years of legal experience and know that the “Magnitsky” law cannot be applied in Bulgaria.

The Constitutional Court was afraid of the consequences that would occur because the Interpretative Decision of 2020 reinterpreted the Interpretation of 1995. Under the old interpretation, when the Constitutional Court overturned a law to amend the law, the previous legal position was restored, leaving the old provisions unconstitutionally changed. According to the new interpretation – for me, extremely wrong, if a law amending the law is repealed, blank fields remain. That is, the old provisions are not resurrected, there is a legislative loophole and the parliament must fix it.

But how to fix her, when she might not want to? And in the case of Hristo Ivanov’s constitutional changes, a Grand National Assembly must be convened – only it can fix them, which cannot be done…

The interpretative decision of 1995 was admired by the colossus of Bulgarian law, Prof. Zivko Stalev. No one has dared to doubt his encyclopedic nature, and in Europe he is known as the greatest authority on the character of judicial acts. I had the honor in 1988 to write a joint article with him in the magazine “State and Law” on the improvement of administrative justice.

– But why, in the presence of a scientific work by such a world scientist, does the Constitutional Court turn the tables? Perhaps the constitutional judges have not read Prof. Stalev’s book?

– The motive is unique! There had to be an evolution in the interpretations of the Constitutional Court and decisions admired by Prof. Stalev are being reinterpreted because there were new social conditions…

– But who are these judges from 2020?

– They are not saying that they are not comfortable, but also because the whole of Bulgaria sees the new social conditions – we have become a Soros colony!

His official, called Hostage Hunter by Vankata Krastev, beat us with the “Magnitsky” club. We renounced our history, censorship is like communism, Bulgarians are deprived of their constitutional right to information. Referendums were banned.

Soon, for the first time in the history of Bulgaria – this will happen in June 2024, we will have two National Assembly – old and new with a total number of deputies of 480. I am happy for Boyko that he will meet his 65th anniversary not only as winner, but also as a deputy in two National Assemblies.

– What if the PPDB decides to cancel the Penal Code in order not to judge the Charlatans and the Constitutional Court cancels the cancellation of the Criminal Code, it turns out that it depends on the PPDB whether they want to accept it again?

– Well, if they don’t want to fill in the white field, we will be left without a Penal Code!

– Is there a way out of Hristo Ivanov’s Constitution in this particular case?

– Prof. Pencho Penev and Prof. Plamen Kirov believe that in this case we are not talking about amendments to an ordinary law, but to the basic law by an ordinary National Assembly.

However, in this case, it is not competent to make the amendments and they should be declared null and void. And by being declared as such by the Constitutional Court, to restore the old constitutional norms for the official government. I think they are right.

Soon there will be radically new social and political conditions in Europe and the world, and one day there will be new constitutional judges. The time will come for the Constitutional Court to return to the 1995 decision.

– The SRAS Republican Party forum is coming up in Budapest on April 25 and 26 against the background of the soldiers in Ukraine, the Middle East and Iran’s attack on Israel. What is expected of him?

– I am grateful to the Hungarian Prime Minister Viktor Orbán’s office for the invitation. There will be right-wing leaders from around the world and prominent Republicans. Viktor Orbán will discover it. Wilders, Tom Van Greeken and many others will also speak. The nail will be the video address of Donald Trump. Along with the traditional motto: “God, Fatherland, Family”, there will also be new messages: “Let’s drain the swamp” and especially “Peace, peace, peace”.

None of the wars he mentioned could and did not happen under the great President Donald Trump. Orban is right – peace has only one name and that is Donald Trump. May God help him to stay alive.

In Europe, there is a rise of conservative movements and parties that are in favor of the nation-state, Christianity and historical memory. Their rise is evident in France, Italy, Austria, the Netherlands, Belgium, the Czech Republic. There is also a rise to the left in Croatia and Slovakia.

Next week there will be a major conservative forum in Brussels organized by the prestigious Edmund Burke Foundation. Farage, Zemur, German Cardinal Gerhard Müller and, of course, Viktor Orbán will speak at it. However, Soros organized agitations to prevent the event.

What is happening in Germany today was unthinkable in 2015, but it is a fact. An alternative for Germany is on the verge of an unprecedented furor. The first political force in East Germany is also the second in the country, but on the way to becoming the first.

The truth will soon emerge about the hundreds of thousands of Ukrainians killed just because Biden and Soros had the crazy fix idea of ​​making Ukraine a NATO country, ignoring the West’s public promises to Gorbachev since 1990 that the West would not expand eastward so that Soviet troops to be downloaded.

Western leaders like Stolz, Macron, Ursula and Rutte bear huge blame for the lie that Ukraine could win the war and for the ridiculous sanctions that hit not the Russian but the European economy.

Only Orban will have a clear conscience. In front of 130 million viewers on Tucker Carlson, he said it was a lie that Russia could lose the war. He constantly calls for peace.
