Brazilian Supreme Court judge opens inquiry against Bolsonaro, based on Sergio Moro’s accusations

A judge at the Supreme Court of Brazil on Monday ordered an inquiry to be opened to investigate allegations of interference in lawsuits against President Jair Bolsonaro, made by former Justice Minister Sergio Moro.

“The analysis of the petition formulated by the Attorney General of the Republic reveals allegedly criminal practices that would have been committed by the President of the Republic in a context that would bind them to the exercise of the presidential mandate, a circumstance that would rule out the possibility of useful invocation, by the Chief of the Executive Power of the Union, of the ‘temporary criminal immunity’ clause, reads in the decision of Judge Celso de Mello, cited by several Brazilian bodies.

On the same note, Celso de Mello pointed out that the Federal Police have 60 days to interrogate Sergio Moro, a former Brazilian Minister of Justice.

On Friday night, the Brazilian Attorney General (PGR), asked the Federal Supreme Court (STF) to open an investigation to investigate the charges made by Sergio Moro, against Jair Bolsonaro.

The request submitted to the STF points to the possible occurrence of crimes of “ideological falsehood, coercion in the course of the process, administrative advocacy, malfeasance, obstruction of justice, privileged passive corruption, slanderous denunciation and crime against honor”.

In the document, Augusto Aras affirms that, if Moro’s statements are not proven, the crime of slanderous denunciation may be characterized.

In the request, the PGR suggests to the STF that, before deciding on the opening of the investigation, collect Moro’s deposition, so that he can formally provide clarification on the possible crimes involved in the conduct of the head of state, and can present evidence of these interferences.

At issue are the statements made on Friday morning by Sergio Moro, who accused the Brazilian President, Jair Bolsonaro, of making “political interference in the Federal Police”, following the resignation of the former head of the country’s Federal Police Maurício Leite Valeixo, published in the Federal Official Gazette.

Moro, who along with the accusations presented his resignation, said that Bolsonaro dismissed the leadership of the Federal Police because he intends to have access to judicial investigations, some of which involve his children or allies.

“The President told me, more than once, expressly, that he wanted to have a person of his personal contact [para quem] he could call, [de quem] he could gather information, [com quem] he could collect intelligence reports. Be the director [da Polícia Federal], be a superintendent “, declared Sergio Moro.

The former judge declared that the Brazilian President personally told him that he wanted to change the head of the Federal Police because he was concerned about ongoing investigations in the STF, which may involve his children or political allies, and wanted to have access to classified reports on investigations. .

Bolsonaro, for his part, denied the accusation of interference made by Moro, said that delegate Valeixo was exonerated because he asked to step down and stressed that it is the responsibility of the President of Brazil to choose who should be the head of the Federal Police.
