Brazil bans Meta from using WhatsApp user data

BrasiliaThe Federal Court of São Paulo has banned the messaging app WhatsApp from sharing the data of Brazilian users with other companies in the Meta Group for their own purposes, such as the personalized insertion of third-party ads, according to a statement issued Wednesday by the Federal Public Prosecutor’s Office (MPF).

The ruling establishes that the rules of application on the processing of this data in Brazil must be adapted to those in force in the European Union.

Under the injunction, WhatsApp is also required to create features within 90 days that allow users to, among other things, opt out of the privacy policy launched by the platform in 2021.

The request was made by the MPF and the Institute for Consumer Protection (Idec).

When contacted by email, Meta and WhatsApp did not immediately respond to a request for comment.

In the lawsuit filed in mid-July, the MPF and Idec demanded R$1.73 billion in compensation for collective moral damages, among other obligations, due to changes in its privacy policy.
