The man who mortally ran over a Telepizza, in Braga, was sentenced to four years in prison with a suspended sentence, charged with the crimes of negligent qualified homicide, omission of assistance and driving under the influence of drunkenness. You will also have to pay compensation of 2 thousand euros to a rehabilitation institution for victims of road accidents and you are prohibited from driving for one year.
According to the court, the businessman, who owns a parking garage in the city of Braga, not only committed the crime of qualified homicide, by colliding and running over the young João Luís, but he also ran away, hiding the car in the said garage. He also allegedly assaulted the policemen who tried to detain him, but was eventually acquitted of that crime.
During the trial, the defendant admitted to remembering much of what happened on the night of August 16, 2018, but he always denied responsibility for the crash and being run over, saying he did not remember that particular fact.
Despite the attempt to ‘evade’ the homicide sentence, the judges did not pick up the allegations, even referring that the 64-year-old accused had “selective memory”. As he was inserted in society, he ended up seeing the prison sentence suspended, to the dissatisfaction of his family and defense, under the responsibility of Rui Santos, with an office in Braga.
The lawyer told O MINHO that the family was satisfied with the number of years of the sentence but did not agree to suspend it. “I still don’t know if the family will appeal to higher levels, but it is certain that both the Relationship and the Supreme Court usually decree that this type of punishment is effective, even if it is necessary to reduce the time to be served”, explained Rui Santos .
The family will have already received compensation for the death of the young man, paid by the insurance company of the car involved in the accident. According to the lawyer, the insurer should now demand the money from the convict. The figures were not revealed out of respect for family privacy.
