“Hardly anyone deserves the death penalty more than the Boston bomber.” When the trial was reissued, the prosecution would have to demand the death penalty again, Trump wrote. “Our country cannot allow the decision of the Court of Appeal to stand.”

Judgment to be reviewed

A federal appeals court overturned the death sentence against Zarnajew on Friday. It referred the case back to a lower court to rule on a new sentence. However, the appeals court only overturned that part of the judgment that deals with the charges of the death penalty.

Even if the death sentence was upheld after re-examination, Zarnayev would at least be sentenced to life imprisonment, the appeals court said.

The 27-year-old Zarnajew was sentenced to death in mid-May 2015.
