The state and public interest requires that all key institutions, which have been left without incumbents, without renewed compositions, etc., for years due to political indolence and lobbying struggles in the parliament, one by one, begin to stabilize and things enter their normal course . The actions of the SJC with the elevation of the candidacy of Borislav Sarafov in the position of chief prosecutor fully corresponds to both the Constitution and this state and public interest. This is what Borislav Tsekov, doctor of constitutional law, said in the broadcast “Bulgaria, Europe and the world in focus” on Radio “Focus”.
“I don’t see any problem, neither constitutional, nor substantive, nor procedural, that the candidacy is one – it’s not the first time. Usually, consolidation of the professional community is sought, and apparently the prosecutor’s guild is consolidated for the candidacy of Mr. Sarafov.”
In his words, the Supreme Judicial Council is obliged to implement the Constitution and carry out the competences it assigns to it, one of which is the election of the three big ones. In this sense, after a certain mandate has expired, they must start a procedure and that without being influenced by political pressure, media interpretations, etc. “The constitution and the law – this should be leading, not what this or that lobby group or political party thinks,” he is categorical.
One of the achievements of Borislav Sarafov, replacing the person who was released early Ivan Geshev was able to return the prosecutor’s office to its institutionality, believes Tsekov, and appeals to the main political forces not to exert party and political pressure on the SJC and the judiciary. “It’s very strange that the promotion of one candidate for attorney general becomes the subject of partisan statements in a flash. This is unacceptable.”
According to the specialist, the impasse and the blocking of the judicial power for political reasons and the inability of the parties in the parliament to understand each other, and at the basis of this inability, according to him, is the reckless ambition of these parties to put their own people, this is the negative for Bulgaria and that would be the subject of a negative assessment by the European Commission regarding Bulgaria’s progress in judicial reform.
