Acting Chief Prosecutor Borislav Sarafov submitted a proposal to the Prosecution College of the Supreme Judicial Council to initiate disciplinary proceedings to impose a disciplinary penalty on Prosecutor Dimitar Frantisek Petrov from the Sofia City Prosecutor’s Office.

During the investigation, all pre-trial cases and files involving Petrov were examined, as well as the pre-trial proceedings that had been stopped by him.

One of the findings of the report is that in several pre-trial proceedings, Petrov did not manage and supervise the investigation effectively. During the investigation of one of the cases, the purposeful conduct of the prosecutor Petrov was discovered to circumvent the law’s requirement for random distribution of files and cases.

After that, pre-trial proceedings were initiated, in which a defendant was brought in and detained for up to 72 hours, without any reason for this.

In another pre-trial incident (related to money laundering), procedural actions were taken as a result of a “grossly incorrect, probable and illegal assessment of facts and circumstances”, which led to the impossibility of actions take special legal action with another supervising prosecutor. .

During the investigation, it was established that Petrov had overseen 41 pre-trial proceedings, and the investigation was not completed. Some of them were found to be slow and irregular in the investigation led by Petrov in his capacity as a supervising prosecutor.

In 17 of the pre-trial proceedings, the rules for the timely preparation of a request to extend the examination period were not followed, as in two of the proceedings the applicant did not prepare Accused Petrov requested to extend the time for the investigation. study at all, although it was forwarded with such a recommendation by the study group.

Prosecutor Dimitar Frantisek Petrov was in charge of 83 pending pre-trial cases. The application sent to the SJC contains the review team’s detailed findings, compiled into nearly 80 pages. He says that the workload of the prosecutor Dimitar Petrov in the period 30.06.2021-28.06.2024 was not too great and did not hinder the conscientious performance of his official duties.

The Chief Prosecutor Borislav Sarafov says in his recommendation to the Prosecutor’s College that with the lack of effective leadership and direction of the investigations and the allowed delay due to the lack of action of the Prosecutor Dimitar Petrov, there were violations disciplinary action in accordance with the Judiciary Act.

At the beginning of July this year, Borislav Sarafov ordered a comprehensive review of the work of prosecutor Dimitar Frantisek Petrov.
