Borgarting Court of Appeal – Six boys found guilty of gang rape

Two of the boys participated in the rape by taking the victim to a shed in a wood, where they left her defenseless to the rest of the group of friends.

Three of the boys used violence and threats to have sexual intercourse with the girl, who was then 15 years old.

The same three boys were also found guilty for a few weeks before having participated in the rape of the same girl.

A sixth boy in the group of friends, also at the time of the crime only 16 years old, was found guilty of aggravated rape by the same victim during the same period.

Conditional

In May last year, the six boys were found guilty by the district court of aggravated rape against the girl.

Three of the accused were sentenced to unconditional imprisonment for 60 days, as well as 420 hours of community service. The last three have been sentenced to 360, 360 and 417 hours of community service, respectively. All appealed the sentence.

In the Court of Appeal, the boys were sentenced to far more severe punishment:

  • Two have been sentenced to four years in prison, of which three years and two months are conditional on a probationary period of three years.
  • One is sentenced to prison for four years and three months, where three years and four months are made conditional on a probationary period of three years.
  • One is sentenced to three years in prison, where two years and four months are made conditional on a probationary period of three years.
  • Two have been sentenced to two years and three months in prison, of which one year and ten months are made conditional on a probationary period of two years.

Discussion about prison

The Court of Appeal significantly reduced the starting point of the sentence for all the boys because they were not much above the criminal minimum age.

The Court of Appeal discussed whether a prison sentence could be imposed, with reference to the fact that the starting point under Norwegian law is that children should not be sentenced to prison. The court concluded that imprisonment was particularly required for all six defendants.

In addition to the prison sentence, they were sentenced to pay a total of NOK 1.15 million in reparation to the aggrieved.
