Borgarting Court of Appeal Bans Satudarah MC Club in Norway

This is revealed in a recent ruling from the Borgarting Court of Appeal.

This is the second time the question of whether the MC club should be banned by law has been dealt with in court.

In 2021, a new law came in which allowed for the prohibition of criminal associations.

The first time the law was tried in court was in the spring of 2023. The police and the state attorney in Oslo wanted to ban Satudarah (SMC).

The prosecution believed that the so-called 1 percent club’s main purpose was to commit crime.

The MC club itself refused this, and was upheld in the district court.

The judgment stated that it is not necessary to ban the MC club in order to prevent serious crime. The public prosecutor appealed the decision.

In a unanimous ruling, Borgarting now reverses and bans the MC club in Norway.

– Overall, and seen in the light of the fear capital Satudarah has in Norway and internationally, and the need to combat serious crime, the Court of Appeal believes that the ban is necessary in a democratic society, the ruling states.

It was State Attorney Ingelin Hauge who led the case in both the District Court and the Court of Appeal.

– The Court of Appeal concludes that this type of 1% club plays on being intimidating, and that the use of violence and threats is a prominent part of the club’s activities, both internationally and in Norway, says Hauge.

Says they are disbanded

The appeal took three days in court. SMC has claimed that they no longer exist in Norway and that the case was “without merit”. They therefore believed that the appeal case had to be rejected or raised.

Lawyers John Christian Elden and Usama Ahmad represented SMC in court.

They are now considering appealing the ruling, although according to Elden it has little significance – since the MC club has been disbanded.

– We represent the former representatives of the non-existent association and will assess whether the ruling is appealed on a principled basis in the same way as the state attorney did to the Court of Appeal. The threshold for a ban is set low, while at the same time it has no practical significance, as there are no members, he writes in an SMS to NRK.

Fear of conflicts

The new ban means that “anyone who participates in, recruits members for or otherwise continues the activity of Satudarah can be punished according to Section 199 of the Criminal Code”, the ruling states.

– The ruling does not make it forbidden to cultivate an interest in motorcycles, but it must be done in other and legal ways, says State Attorney Hauge.

Internationally, the so-called 1% club is notorious for drug dealing, violence and other organized crime.

The police have been keeping a close eye on SMC since they tried to settle in Eastern Norway in 2018.

They feared that the establishment could, among other things, lead to conflicts with other criminal circles.

The stabbing at Solsiden in Lillestrøm in December 2022 and the shooting at the National Theater in Oslo in January last year are part of a long series of cases that the police believe can be linked to the Satudarah MC.

When the issue of a ban was dealt with in the district court, the former president of the club stated that they were an association where the MC interest was cultivated.

NRK has investigated how many of the well-known members in Oslo own motorcycles.

Of the 12 people who will form the core of the MC club, only three are listed in the vehicle register with motorcycles.
