A 54-year-old man from the eastern part of Lake Constance admitted to the Tettnang District Court that he had set up a WhatsApp group in 2016 in which he sent swastikas to 23 members from “Spa”, among other things. The man, who was accused of sedition among other things, was sentenced to a fine of 1,400 euros.

The 54-year-old had led the group for a good two years and, among other things, called for media reports on violence against foreigners and published the addresses of politicians and actors. “I shoot everything that comes, you can visit me in prison,” it said, among other things. The accused also announced in the group that he was shooting into the crowd with a machine gun with the addition: “I hate that (…) Saupack.” As it turned out during the hearing, he had bought a manipulated gun with a silencer, for which he did not have a gun license. Rather, the competent gun authority had previously revoked the issuance of a gun license.
Police found chat history on a group member’s cell phone
The man was blown because the police had found the chat history on the cell phone of another group member. During a house search in May, another rifle, a quiver with arrows and blowguns were found in the defendant’s home. He was a sports sweetheart, said the defendant. Marks of unconstitutional organizations have also been found on books, rings and knives. “It was all just a joke,” said the 54-year-old. It is about satire in the sense of Jan Bhmermann.

Judge Franziska Fischer-Missel didn’t think it was funny. “Shoot into the crowd with a machine gun, that’s what you said in front of people who agree. So it depends on chance whether after two years someone doesn’t think: Why not, ”she said in her reasoning for the judgment.
In relation to the prosecution’s request for a nine-month suspended sentence, the verdict remained mild. In his pleading, defense attorney Pavel Oresnik referred to the confession and a good social prognosis, as well as the limited scope of the spread. This lacks the characteristic of the struggle for peace and the judgment must remain in the area of fines. The defendant apologized, accepted the verdict and pays the costs.
