In the early afternoon the council, chaired by the dem Dario Franceschinihad voted in favor of the report to talk (FI), which had posed the need to respond negatively to the investigators’ request, recognizing second-level fumus persecutionis against Sangiuliano. Already in the council the compact majority had expressed itself in favor of the report, while the oppositions were against it: Pd, M5S, Avs, Italia viva. It is therefore not a request, as usually happens to parliamentarians and ministers, aimed at authorization for judicial proceedings.
But as explained by the rapporteur Paroli “in the present case the evidentiary purpose of the seizure is not expressed with respect to the concrete configuration of the crimes prosecuted”, therefore “the indiscriminate acquisition of an indefinite series of data, as well as damaging the confidentiality of the suspect , does not appear finalized and functionally correlated with the demonstration of the hypotheses of crime for which proceedings are being carried out, also demonstrating in this case the disproportionate nature of the provision which gives rise to the plausible suspicion of the existence of fumus persecutionis of the second degree”.
A position shared by FdI and Lega, while the opposition, in a united way, expressed the need for the green light from the court. The correspondence “is a necessary and indispensable piece of evidence”, said the senator Anna Rossomando of the Democratic Party, speaking in the Chamber.
