Bobigny: new complaints against figures of the former UDI majority


Like an air of deja vu. This Wednesday morning, the town hall of Bobigny organized a press conference at the town hall to announce the filing of several complaints concerning the management of Semeco, the mixed economy company which manages public spaces and district heating in the municipality.

Five months after becoming a civil party in the procedures concerning the management of the Public Housing Office (OPH) under the former UDI mandate, Mayor Abdel Sadi (PCF) was this time surrounded by Waly Yatera , his housing assistant and president of Semeco. The latter detailed the complaints against the company which, like the OPH, is chaired by an elected member of the municipal majority.

Procedures relating to accusations of “abuse and concealment of abuse of corporate assets” around a collective contractual rupture (RCC) target four former executives of Semeco. The objective of this RCC, validated by the Board of Directors in September 2019, was to reduce the company’s payroll by encouraging its employees to leave.

A financial director left with 288,209 euros

“Four executives have benefited from exceptional conditions of collective contractual termination with regard to the financial situation of Semeco, details Waly Yatera. The compensation they received was completely disproportionate. »

A legal manager thus obtained 136,800 euros, a human resources manager 161,353 euros, a HR manager 230,266 euros and a financial director 288,209 euros.

“We are talking about people who had only a few years of seniority,” recalls Mario Luciano, the new general manager of the semi-public company. His predecessor Rachid Maalem is also being prosecuted in this case, “because he was responsible for Semeco at the time of the events”, specifies the company.

The members of the board of directors present during the validation of the RCC – including former elected representatives of the UDI majority – are also the subject of proceedings for “abuse of power” and “complicity in the abuse of corporate assets”. .

Another grievance pointed out by the new team in place: the fact that the validation commission – which validated or refused the files of the employees who were candidates for departure within the framework of this break – was precisely composed of the executives who then benefited from it.

“In this story, they were judges and parties”, points out the new general manager of Semeco. “What is more disturbing is that we have not found any document stipulating their professional projects allowing us to understand why their files have been validated”, abounds Waly Yatera.

“Mr. N’Diaye bought the silence of Mr. Maalem in view of the municipal elections”

In addition to these complaints, there is another procedure aimed at the transactional protocol signed at the time of the departure of the general manager Rachid Maalem – who was dismissed from his post in January 2020 – and the president of the structure at the time, Mahamadou N’Diaye , who was deputy mayor for early childhood.

“For us, this agreement is akin to a secret political agreement, points out Waly Yatera. The text is edifying. Mr. N’Diaye bought the silence of Mr. Maalem in view of the municipal elections. He is committed to political neutrality, not to participate in any political demonstration until the result of the second round. In exchange, he received 259,500 euros in compensation. »

According to Semeco, the agreement was to benefit Christian Bartholmé, then first deputy and head of the UDI list in the municipal elections. “He couldn’t not be aware,” said Waly Yatera. Mr. N’Diaye was one of his running mate. Why force Rachid Maalem into silence? “That’s the whole question we ask ourselves,” we whisper at the town hall.

In this case, Semeco filed a complaint for “misuse of corporate assets, concealment of abuse of corporate assets and abuse of power” against Rachid Maalem, “abuse of corporate assets and abuse of power” against Mahamadou N’Diaye and “complicity abuse of corporate assets and complicity in abuse of power and concealment of abuse of corporate assets” against Christian Bartholmé.

“The city will be a civil party in these procedures,” said Mayor Abdel Sadi, denouncing cases that reinforce “mistrust of politicians”.

“I had no responsibilities within Semeco when Mr. Maalem left [NDLR : il en a eues jusqu’en 2018], he recalls. I have never heard of this protocol. If I had wanted to force Mr. Maalem into silence, would I have really done so just one month before the municipal elections? The campaign was already well advanced! It’s absurd. And to hide what more? If there are records, why hasn’t the new majority found them? She only multiplies the complaints against me: at Semeco, at the OPH, because she knows that everyone will talk about it. And that avoids the press to be interested in her. »
