The president of Guatemala, Bernardo Arévalo de León, did not rule out this Monday (04/29/2024) the holding of a popular consultation to remove the attorney general and head of the Public Ministry (Prosecutor’s Office), Consuelo Porras, who tried to prevent his inauguration.
“Regarding the popular consultation, that is an option that we are considering within the framework of the different legal actions, which we have said, to free the Public Ministry from the illegal political-economic ‘network’ that at this moment has control over it” , the president stated at a press conference. However, he warned that “it is not a decision made” and that for the moment all options are on the table for analysis.
Guatemalan law establishes that the only way to remove the attorney general is through a judicial conviction against her.
The controversial role of Consuelo Porras in the Prosecutor’s Office
Porras tried, through various legal maneuvers, to avoid the investiture of Arévalo de León since he advanced to the second round of the elections held in 2023.
The head of the Guatemalan Public Ministry was sanctioned in 2022 by the United States, as was the leadership of the entity, with the withdrawal of her visa under allegations of corruption in the Central American country.
In September 2023, Arévalo de León publicly accused Porras of trying to carry out a “coup d’état” against him to prevent him from coming to power after surprisingly winning the 2023 elections.
The popular consultations in Guatemala are under the coordination of the Supreme Electoral Tribunal and the last one was carried out in 2018 on the existing territorial dispute with Belize.
