Berlin Senate is allowed to close restaurants

The Berlin administrative court decided on Tuesday morning, as confirmed by a plaintiff in the Berliner Zeitung. The decision was initially made on 22 applications from Berlin restaurateurs who had complained against the forced closure of their restaurants by the end of November, as provided by the current Corona ordinance of the Senate.

In fact, around 80 other proceedings are still in court. According to a spokesman, 55 of these also come from hosts, so the outcome should be similar to the first 22 procedures. The remaining two dozen applications come from the hotel, theater, event and sports sectors, among others. According to the RBB, one of the applicants is the cabaret artist and theater director and manager Dieter Hallervorden, who is taking action against the closure of his theater in the palace gardens.

Most of the 22 applications initially approved come from the law firm of lawyer Niko Härting in Mitte. He argues that closing his clients’ premises is disproportionate. They have no relevant use for fighting the pandemic. With this argument, Härting has now failed before the administrative court.
