Berlin: Referendum on a car-free city center probably inadmissible

The Berlin Senate Department for the Interior considers the referendum for a car-free city center to be inadmissible. “The draft law presented with the referendum violates the Basic Law,” said the deputy spokeswoman for the interior administration, Sylvia Schwab, on request. “The intended regulations, to ban private car traffic in the entire inner city area by law and only allow it in exceptional cases, are disproportionate and incompatible with the general freedom of action.” The Rundfunk Berlin Brandenburg had previously reported on this, citing a statement from the interior administration, which the broadcaster has received.

The interior administration had checked the admissibility of the referendum. The result went to the responsible traffic administration on May 4, 2022, the spokeswoman said. This will develop a proposal for the Senate so that it can decide on its position on the referendum within the prescribed period of 15 days. That could happen as early as May 17th.

The draft of the alliance “Volksentscheid Berlin autofrei” envisages declaring almost all streets within the S-Bahn ring to be car-reduced areas. Last year, the citizens’ initiative in Berlin handed over more than 50,000 signatures to the interior administration for their request and requested the initiation of a referendum. This requires 20,000 valid votes. According to an earlier check by the internal administration, this requirement was met.
