Constitutionalist Joël Aïvo, imprisoned since 2021 for undermining state security and money laundering, wrote a letter to the Minister of Justice and Legislation, Séverin Quenum, to alert to the case of several people detained without trial. for 10 to 20 years.
In his letter, Joël Aïvo recalls that the maximum duration of pre-trial detention is five years in criminal matters and three years in correctional matters according to article 147 of the law on the Code of Criminal Procedure in the Republic of Benin. He points out that several detainees are still awaiting their judgment and have been for several years. Joël Aïvo thus pleaded for action to be taken to resolve these alarming situations which illustrate the gap between rhetoric and reality on the functioning of justice in Benin.
The constitutionalist specified in his letter that he succeeded in getting some detainees out of prison thanks to his lawyers, but that others still remain in pre-trial detention without trial. He therefore called on the Minister of Justice and Legislation to take action to resolve this situation and allow these detainees to be tried within the time limits provided for by law.
