Benešová does not suspect the constitutional judge of political pressures, but only allegedly wanted to draw attention to the repetition of the mandate Home

Prague The Minister of Justice Marie Benešová (for YES) stated that she respects the decision of the Constitutional Court on the electoral law, but does not agree with its timing. The constitutional judge does not suspect political or other pressures. In a statement sent, she explained that in her earlier statement she wanted to point out that “if the mandate of the constitutional judges had not been repeated, such doubts would not have arisen at all”.

On Wednesday, the Constitutional Court annulled part of the electoral law due to violations of the equality of the right to vote and the chances of candidates. Coalitions of parties and movements will need to get five percent of the vote to enter the House.

Benešová then commented on the finding for Deník N. In the interview, she described the decision as strange, according to which it does not seem objective. “Judges are just people, some want to repeat the mandate,” she said. “What’s behind it? To whom did someone commit, who did he promise to whom? ”She continued. She called the decision a “top number” over which reason remains. Her statement provoked criticism from the Judicial Union and the Union of Prosecutors.

“I noticed that my words yesterday (Wednesday) to the address of the Constitutional Court live in the media space with their own lives. Therefore, I would like to explain how I meant them so that they are no longer misinterpreted, “the minister now said.

“I wanted to provoke a discussion on the problem and I emphasize that I respect the decision of the Constitutional Court. But I deeply disagree with his timing. The decision came after more than three years, at a time when we are dealing with a coronavirus pandemic and we are on the verge of election, “she wrote.

“I have never suspected a constitutional judge or said that they are subject to political or other pressures. I believe that they are independent in their decision-making. I am convinced that the root cause of the whole problem lies in the possibility of repeating the mandate of the constitutional judge, “she said. She added that whoever considers remaining in office must receive political support for him – in the case of constitutional judges, the support of senators, ie those whose proposal the judges decided on. Senators approve constitutional judges on the proposal of the president.

The Minister also pointed out that the discussion of the law takes a year in the Chamber of Deputies, even if there is agreement on it. “Finding agreement in such a complex matter, which will affect the results of the elections and must pass through both chambers of Parliament, can cause a constitutional crisis. I believe that none of us wants that, “she concluded.
