Batres proposes to ministers a transition table to guarantee the reform of the PJF

Mexico City. Minister Lenia Batres Guadarrama proposed to the Plenary of the Supreme Court of Justice of the Nation (SCJN) that, upon approval of the reform to the Judicial Branch, a transition table be installed that, among other things, “formulates a proposal for necessary reforms in the secondary legislation that, by mutual agreement between the members of this Plenary, must be considered to guarantee the viability of the jurisdictional function with the changes entailed by the application of the constitutional changes regarding the Judicial Branch of the Federation.”

In the proposal that was presented yesterday, the minister states in her writing that “in light of the confrontation that reached the point of allowing the unprecedented incursion of personnel from the Judicial Branch into a building of the Legislative Branch to sabotage the exercise of a constitutional power of that branch, I consider it necessary to call for prudence, responsibility and institutionality of the community that makes up the different organs of the PJF.

“It is up to the Plenary of the SCJN to assume the leadership role that is its responsibility as the head of one of the three branches of the Mexican State.”

Batres Guadarrama told the members of the Court that “given the imminent approval of the reform in the area of ​​the Judicial Branch by the majority of the congresses of the federal entities of our country, it is necessary to generate the conditions that allow – in addition to a regular functioning of the Judicial Branch – to participate constructively in the new democratic era, which will shape this power.”

The proposal for a transition table mentions that the Federal Judicial Council (CJF) should be convened to design the regulatory instruments that allow taking advantage of the resources that the current Judicial Branch has for the installation and operation of both the administrative body and the Judicial Disciplinary Court approved in the constitutional reform.

The document, which was received today by the presidency of the Court, states that the Court, together with the CJF and the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), “will take appropriate measures to ensure compliance with the financial and labor obligations indicated in the reform, such as the extinction of trusts and the adoption of limits on remuneration, with strict respect for the rights of workers.”

It also mentions that an institutional channel must be created that is suitable for receiving regulatory proposals from the permanent and trusted staff assigned to the courts, tribunals, the Court and other administrative areas, to submit them to the Legislative Branch for consideration.

He concludes his writing by pointing out that a transition table “can help to rebuild the constitutional order and rectify the ordinary work of the Judiciary.”
