Fitness chain Basic-Fit will then no longer charge subscription fees as long as the fitness centers remain closed. Athletes who had to pay incorrectly in recent months will also receive compensation as soon as the chain reopens. Last week, consumer organization Test Achats called the Dutch fitness chain on the mat because she didn’t obey the legal rules.

Fitness chains in our country have been closed since 23 October, but Test Achats received a lot of complaints from Basic-Fit members who stated that the membership fee continued as usual.
The consumer organization therefore sent a notice of default to the Dutch fitness player, asking them to suspend subscriptions and payments for the duration of the quarantine measures. In addition, she asked for a full refund of the monthly payments wrongly received since October 23.

‘Almost forced to remain a member’
Basic-Fit has meanwhile amended its policy and brought it into line with the law. For example, no more membership fees will be debited until the fitness rooms reopen. The monthly amount that consumers have wrongly paid since the closure will be deducted from the monthly membership fee over a period of six months from the reopening.

Test Purchase is cautiously satisfied with the measures, but regrets that the refund is not made in one go. Many customers want to cancel their subscription in the light of the corona crisis, but by spreading the reimbursement over six months they are almost forced to remain a member. For Test Achievement, contracts that cannot be executed for reasons of force majeure must not only be frozen, but also be able to be terminated with refund of what has been unduly paid.

Fitness chains still at fault
In addition to Basic-Fit, there are many other fitness chains active on the market that violate the rights of consumers in these corona times, says Test Achats. More specifically, according to the organization, this includes Fit Out, Keep Fit and Fitality. They too can expect a notice of default, the consumer organization makes a case.
