A bartender in Aruba has discovered that sipping on an alcoholic beverage not only causes a hangover, but also a dent in his career. After the judgment of the Court of First Instance, he had to say goodbye to his beloved job and a large chunk was taken from his monthly salary.
The Aruban man enjoyed his role as go-to cocktail master, until that one fateful day arrived. In December, he was suspended and later fired for violating company rules. It was alleged that he consumed an alcoholic drink while working at the Lucca restaurant. Video footage showed him pouring whiskey into a cardboard cup behind the bar and then walking out with the cup.
Rules are rules
The catering company did not take any half-hearted measures and decided to take legal action to terminate the bartender’s employment contract. Rules are rules, after all, and consuming alcohol during working hours was strictly prohibited by company regulations.
Still, the man demanded his job back at the court, arguing that the dismissal was too severe a punishment. Among other things, he denied that he stole the whisky; according to him, a customer had offered him the drink. But the judgment of the Court of First Instance confirms that the employer was right. Drinking alcohol during working hours is not allowed, so the dismissal is justified, according to the court.
In addition, the court gave little credence to the argument that the drink had been offered by a customer. The cash register data showed that no whiskey had been sold during those specific hours.

The bartender said that he normally never drank during his working hours and almost always refused drinks offered. He sometimes made an exception only with his manager’s permission, for example if a customer had something special to celebrate.
In addition to losing his job, he must also pay part of his employer’s legal costs. It concerns an amount of 3150 Aruban florins, which amounts to approximately one and a half times his net monthly salary. So he will have to give up his hard-earned money.
