The husband took his wife out of the car and beat her in front of their home, in the presence of the two children. “There are witnesses. Separately, the complex in which they live, again in view of their financial status, is one that is guarded by cameras, that is, everything is recorded. She suffered very serious bodily injuries, an ambulance had to come and help is provided. Neighbors and friends literally save her life,” said the lawyer. Kadieva.
“Very difficult proceedings, which are developing in parallel in two parts – criminal and civil. The civil proceedings are faster in terms of time. We already have a decision of the first court instance, which is entirely in favor of the mother and the two children. They have received the maximum under the law, protective measures that are allowed. The abuser is required to attend specialized programs to work with perpetrators of domestic violence. The proceedings are on appeal, because of course the abuser is not satisfied with the court decision, despite the overwhelming amount of evidence We expect the criminal proceedings to develop in the same adequate way,” she added.
According to Kadieva, when the proceedings develop adequately and the sanctions and measures are adequate, then we can talk about positive examples and more people dare to talk about what they experienced and reach the last step – to defend themselves in court.
“That’s why the changes are so important, some of which are still pending, some of which have been adopted in the Law on Protection from Domestic Violence. It depends on what will the parliament will have in the future. We have been waiting for these changes for almost 5 years. Discussions and votes are underway. If the current parliament there is a slightly more adequate attitude to the problems of domestic violence, the victims will be more protected. This includes not only women and children, but also elderly people and many men,” added the lawyer. Kadieva.
Her prediction is that the cases of domestic violence will not stop increasing until the thinking and behavior in society undergoes a radical change – that violence is not tolerated and aggression is not accepted as a model for success.
