–Why did the Bar Association take such a critical position regarding the Omnibus law?
–There are technical issues introduced in the bill with the attempt to deregulate all types of procedures. It implies the modification of non-contentious divorce, it takes it out of the judicial sphere and brings it to the administrative sphere; That is to say, it dispenses with legal sponsorship. Regarding successions, it is the same approach. In reality, the jurisdictional process cannot be dispensed with, nor can legal representation be dispensed with. As a school and at the provincial level, the federation and at the national level, Faca, we claim our professional role and defend our duties. If it is necessary to go to court, we will do so and we have also initiated political actions, which are communications to all national legislators in Córdoba, from all political parties, making known the position of the Córdoba Bar Association on why it cannot be approved. this bill, why you can’t do without the lawyer.
–Why should it not be dispensed with?
–Firstly because of the professional responsibility. The National Interuniversity Council (CIN) established the curricula in each faculty and university. In the case of the Faculty of Law, to be a lawyer it is necessary to pass the Family and Inheritance subjects; It is part of our work. Second, because we are here to protect the rights of citizens. When these are affected, in the future it will mean greater congestion in Justice and greater costs for those who accessed an administrative procedure without the participation of a lawyer. –What response did they have in political contacts?
–Everyone is surprised, not only by the proposal that we lawyers make, but by what the Omnibus law means. In what we propose from the school we are receiving a good reception from the legislators.
–Those who lose are strong concerns. What do they imply at work?
–The spectrum of our interventions is greatly reduced. They are not minor issues, they are transcendental. We are not willing to lose them without fighting in the corresponding institutional settings. This is not a new project. Every government that takes office, of whatever political nature, always tries to advance over the legal profession. It implies the invisibility of rights. It happened to us with Anses and with the medical commissions, which we managed to reverse.
–Don’t you think that this intended progress is not due to the fact that the presence of lawyers generates a high level of litigation?
–The analysis must be deeper. It is not about removing lawyers from the field and saying that the trial industry is generated by our activity. We must create a debate table where all the actors are seated and seriously discuss what needs to be brought to justice. There are issues that can be resolved outside, but with the participation of the legal profession. Without it it will be difficult to protect the rights of citizens.
