Bankruptcy Lawsuit against MNC Group Subsidiary Rejected by Central Jakarta District Court Page all

JAKARTA, KOMPAS.com – Application bankrupt filed by KT Corporation against PT Global Mediacom Tbk (BMTR), was rejected by the Commercial Court at the Central Jakarta District Court (PN).

KT Corporation is a telecommunications company from South Korea. Meanwhile Global Mediacom is a part of MNC Group, a company owned by Hary Tanoesoedibjo.

In a decision, the Judiciary evaluates the bankruptcy application, failing to prove the credentials of creditors who have two or more creditors.

In addition, at least one debt is due and can be divided, so that the provisions of Article 2 paragraph 1 of Law Number 37 Year 2004 cannot be fulfilled.

“Therefore, the bankruptcy application submitted by the applicant must be declared rejected,” said the Judiciary in a conference in Central Jakarta District Court, Wednesday (30/9/2020).

With the refusal of this petition, KT Corporation is also required to pay compensation for court fees arising from the dispute.

Responding to this, Global Mediacom’s attorney Hotman Paris Hutapea said the verdict emphasized that KT Corporation did not have sufficient evidence to file a bankruptcy request with Global Mediacom.

“We don’t know where he came from, confess can transfer the contract from another company, but for the transfer of the contract there must be a transfer agreement. He doesn’t have one, so he really doesn’t know where he is, “said Hotman in his statement.

He said that in the first trial he argued with the attorney of KT Corporation. However, according to him, the South Korean company did not have a suitable work contract to serve as evidence.

“He said he had a transfer contract from another company, we continued to ask, finally it was included as evidence, it turned out that there was nothing that said what contract was transferred, it didn’t exist. So, it really was. nobody, we don’t know, “he concluded.

For information, KT Corporation sent lawsuit bankruptcy of Global Mediacom to the Central Jakarta District Court on July 28, 2020. This case was registered under number 33 / Pdt.Sus- Bankrupt/ 2020 / PN Niaga Jkt.Pst.

In the petitum of the plaintiff’s lawsuit in this matter, KT Corporation represented by Warakah Anhar, there are several matters requested to the jury.

One of them, the applicant asked the jury to accept and grant the entire bankruptcy application.

KT Corporation also asked the court to appoint and appoint, and appoint a judge in the Jakarta Business Court as the Supervising Judge.

The plaintiff also asked the court to appoint and appoint three curators and managers, namely Fennieka Kristianto, Yongki Martinus Siahaan, and Ronal Hermanto to become the curatorial team in the Global Mediacom bankruptcy process.

All three have been registered with the Ministry of Law and Human Rights (Kemkumham).

For the curatorial services, KT Corporation also asked the panel of judges to determine the curator fee which will be determined later according to the applicable provisions after the curator performs his duties.

KT Corporation also asked the jury to convict Global Mediacom to pay the full cost of the case.
